The Terms and Conditions stated here are legally binding. You must immediately cease using the Website if you do not agree with the Terms set out in these Terms of Use. Interacting with the website by browsing, reading, or using the Website, represents your understanding and acceptance of these terms. The Terms of Use apply to everyone use interacts with the Website. You must be at least 18 years of age to use this Website.

Doctor Becc retains the right to change these Terms by updating this page at any time. These changes take effect immediately once published on this page. We recommend you keep a copy of the terms at the time that you are interacting with the Website for your records.

DISPUTE RESOLUTION:
If a dispute arises out of this Agreement that cannot be resolved by mutual consent, mediation will be attempted in good faith between the you and Doctor Becc for up to 60 days after notice given. Arbitration will be handled in person in Launceston, Tasmania, Australia.

We will not be liable for any loss, damage, cost or expense incurred by you in connection with the use of this website in any event. You indemnify us from and against all claims, suits, demands, actions, liabilities, costs and expenses resulting from your use of the website.

GOVERNING LAW:
You may only use the website for lawful purposes and in a manner consistent with the nature and purpose of the website. Your use of this website and any dispute arising out of your use of it is subject to the laws of Victoria.

NO WAIVER:
The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
Coaching Service Terms of Service
'Coach', 'our', or 'we' refers to staff, contractors or representatives of Doctor Becc (ABN 12 345 730 683)
'Client', 'you', 'your', or 'yours' refers to the person engaging the coaching service
COACHING RELATIONSHIP:
The coaching is a partnership between the Client and Coach aims to develop the Client’s awareness and ability to identify and achieve their personal and professional goals. Coaching is helping people learn rather than teaching them. The coach is committed to act in all times with full commitment and good faith. The Client's full participation, openness, and commitment to the coaching process are required to achieve results. The Client agrees to raise all issues and concerns regarding the Coach-Client relationship. The Coach can always be contacted at chat@doctorbecc.com.au for questions or concerns.

The Client acknowledges that this coaching service is not professional medical or mental health advice or care. Neither the Coach nor Doctor Becc is any way acting in the capacity of a medical professional or service. Neither this Website nor Doctor Becc provide medical advice related to Doctor Becc as a business entity. No information or advice given is to be interpreted as medical advice.
Coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. The Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. The Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
THE COACHING PACKAGE:
The Coach and the Client agree to participate in the Coaching package through online sessions. The coaching package includes 4x weekly sessions of 30-minute coaching sessions over 4 consecutive weeks (4x 30-minute sessions in total). Video sessions will occur over Zoom. Between video sessions, the Client and Coach can communicate via Facebook voice messages. The Coach will endeavour to respond within 24 hours, however, the Client acknowledges this is not always strictly adhered to.

If the Client wishes to disclose personal information over these communication services, they do so at their own risk. The Client understands that the use of technology is not always secure and accepts the risks of confidentiality in the use of email, text, phone, Zoom and other software or communication media. The Client acknowledges that any information or confidentiality breaches related to third party websites and software are out of the control of the Coach. The Coach holds no liability for costs or damages related to this.

The Client is not permitted to share any of the content (including but not limited to recordings, interactions, messages) provided by or shared between the Coach and the Client without expressed written consent from Doctor Becc or the Coach.
BOOKINGS:
All bookings are made through DoctorBecc.com.au. Potential appointment times are made available at the discretion of the Coach and the Coach will endeavour to make agreeable times available to facilitate convenience for the Client. The Client acknowledges the variable limitations of availability of the Coach. If there is no suitable time suitable available to the Client on the booking calendar within reason during the 7-day week, please contact chat@doctorbecc.com.au to discuss options to facilitate the coaching call.

An email will be sent to the Client with the link to the meeting at the accepted time. The Client will initiate the Zoom Call with the Coach via the link provided by email.
BEFORE THE FIRST SESSION:
The Client must return the Client contract signed within 24 hours for the first session to commence.
CONFIDENTIALITY:
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality. Please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions). Hence, communications are not subject to the protection of any legally recognised privilege. The Coach agrees to not disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent.
Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity.
The Client acknowledges his or her continuing obligation to raise any questions or concerns with the Coach in a timely manner.
FEES & PAYMENT:
Fees and charges listed for services are subject to change. The Website pricing at the current time reflects the most up-to-date price.
Payment is made via the website prior to the first coaching session. Payment can be made upfront in-full or weekly. Weekly payments must be made prior to the session booking.
REFUNDS:
We understand that the Coach-Client relationship is critical to Client success and that coaching with Doctor Becc is not necessarily suitable for every person. We value mutually beneficial relationships and hence offer the option to receive a refund after the first session if for whatever reason the Client would like to cancel. If after the first of the 4 weekly coaching sessions the Client would like to cancel their 4-week program for any reason, a full refund of the amount paid by the Client for the session will be refunded in full as long as the Coach is notified via the website feedback form within 24 hours of this first session.

Refunds will not be issued at any other point in the 4-week program. The Client is liable to pay the fee for the full 4-week program regardless of whether they choose to attend the subsequent sessions.

Refunds will occur in the original payment method and may be subject to delays related to this. Doctor Becc will facilitate the refund as quickly as reasonably possible.

CANCELLATION:
Cancellation of a session more than 24 hours before a scheduled session are able to be rescheduled within the times made available by the Coach in the respective 7-day Monday-Sunday period. The Coach will attempt in good faith to reschedule the missed meeting.
Cancellation of the first scheduled coaching session within 24 hours of session commencement will result in forfeit of the full fees for the respective session. Failure to attend a scheduled coaching session will incur full fees for the respective session. The Coach reserves the right to bill the Client for a missed meeting.
GUARANTEE:
By the nature of coaching as a service, the onus is on the Client to take the action as guided by the Coach to achieve the desired results. The Client takes full responsibility for their own results and outcomes. The Coach acts as a guide to the Client and is in no way responsible or liable for any undesired outcomes or losses related to this.
We do not provide warranty or guarantee regarding the performance, accuracy, timeliness, completeness or suitability of the content on this website for any particular purpose. The Client acknowledges that such content may contain errors and inaccuracies. We expressly exclude any liability for such to the fullest extent permissible by law.

The Coach makes no guarantees, representations or warranties of any kind or nature regarding the coaching services agreed upon or provided. The Coach is not liable to the Client for any indirect, consequential or special damages. Doctor Becc shall remain blameless for any adverse outcomes, including but not limited to financial, personal, employment or other losses, arising out of decisions or actions the Client may make as a result of the Services provided by Doctor Becc.

The Coach’s entire liability is limited to the amount actually paid by the Client to the Coach for all coaching services rendered through and including the termination date.

DISPUTES:
Whilst Doctor Becc is committed to act at all times in good faith, we acknowledge that disputes may arise. If a dispute arises out of this Agreement that cannot be resolved by mutual consent, mediation will be attempted in good faith between the Client and Coach for up to 60 days after notice given. Arbitration will be handled in person in Launceston, Tasmania, Australia.
